What is ACT114A?
ACT1114A, also name as Section 114A, “Presumption of Fact in Publication”. It’s a new amendment to the Evidence Act 1950. The amendment that passed in parliament in April 2012 declares that any owner, administrator, host, editor, subscriber of a network or website, or owner of a computer or mobile device is assume to have published or re-published its contents. The law will impact everyone which is from individual users to businesses.
How would ACT114A affect you?
As the law has been announced, we will not know how it going to apply, but how would ACT114A affect? If let say, normally nowadays people using smart phone, they log in their facebook or twitter account automatically in their phone. What happened when someone use their phone to post something which is very sensitive issue? But it’s not origin comment from the owner but from other people. Under Section 114A, the person is guilty of publishing the tweet/status and can be sued. He/she needs to prove he didn't do it.
Does it really matter?
That is absolutely does matter every one of us. I believe everyone know that there is a lot of enemy or haters around us. They could use this law as their weapon to harm anyone of us. It’s very dangerous and guiltlessness if this really happened.
Should you be concerned?
Undeniably, I’m very concerned about this issue because the probability of me and even others internet users will be affected by this law. The law can cause the cons and pros, and obviously it cause cons more than pros, so, we should concern about this issue, not only me.

Overall, I do agree with your opinion. But I have something to add in, as what you mention above, I agree they could use this law as their weapon to harm anyone of us and who knows one day I might be one of the victims. But this law also had its important. It had catch up many irresponsible people who posted the offensive and illegal contents. These will reducing the social dispute.
ReplyDeleteI'm pretty much agree with your statements but this: "I believe everyone know that there is a lot of enemy or haters around us." doesn't apply to everyone. We may not have haters or enemies, it doesn't only apply to haters and enemies but at times, your closest friends who planned on playing a small trick on you can cause you trouble under this amendment.
ReplyDeleteSomehow I think I have to agree with what you just commented. Not everyone has enemy and haters around us, it should be only majority or minority of us has it. And nowadays teenagers is under rebellious period and getting playful, they will really make some mistake like what you said, they will plan to play some trick, and it's without thinking and bother it.
DeleteHaha. I do agree with Jennyi. Many of us have been fooled or tricked by our own friends around us by posting some "silly" stuff using our account, but not haters or enemies. Moreover sometimes even ourselves doesn't know who we've offended, accidentally maybe? We couldn't blame others for hurting us but we ourselves must be careful on this.

Everyone has different characteristic, the way of talk, the way of treating people, others might not like our characteristic even we think we have no wrong sometimes. And accidentally have offended somebody.
